VINTEMOD.com Distance Sales Agreement

  1. Introduction
    This document (along with all other documents mentioned below) sets out the terms and conditions ("Conditions") regarding the use of the website and the purchase of products through this website. Customers should read these terms before using the website. By using this website or placing an order through the site, you, our valued Customer, expressly agree, declare, and undertake to be bound by these terms. If the Customer does not accept all the Conditions, they should not use the website. These Conditions may change. It is the Customer's responsibility to read them regularly, and the terms in effect at the time the Customer uses the website or forms the Agreement (as explained below) will be applicable to the Customer.

  2. OUR INFORMATION

  3. YOUR INFORMATION AND VISITS TO THE WEBSITE
    To purchase the desired product, the Customer is required to share personal information. The information or personal data shared with VINTEMOD.nl is processed in accordance with the Data Privacy Policy. By using the website, the Customer confirms that all information shared with VINTEMOD is accurate and true and agrees to the processing of this information and personal data. If the Customer explicitly expresses interest in VINTEMOD.nl, VINTEMOD may inform the Customer about the latest collections, catalogs, campaigns, and special offers via mail, email, and/or SMS.

  4. USE OF THE WEBSITE
    By using the website and/or placing an order through the website, the Customer agrees to:

VINTEMOD may use this information to contact the Customer if necessary (see Data Privacy Policy). If the Customer does not provide all the required information to VINTEMOD to complete the order, VINTEMOD may not be able to complete the order. When the Customer places an order through the website, they confirm that they are at least 18 years old and legally capable of entering into binding contracts.

  8. AVAILABILITY OF SERVICES
    The products offered on this website are only available for delivery within the Netherlands.

  9. CONTRACT FORMATION
    To place an order, the Customer must follow the online purchase process and click on "Confirm Payment". After doing so, the Customer will receive an email acknowledging receipt of the order ("Order Confirmation"). In a subsequent second email, the Customer will be informed that the order has been accepted and dispatched ("Delivery Confirmation"). If VINTEMOD does not provide such confirmation to the Customer, the Agreement will not be formed.

  10. PRODUCT AVAILABILITY
    All orders are subject to availability. In case of supply difficulties or if products are out of stock, VINTEMOD reserves the right to inform the Customer about substitute products of similar or different categories and value that the Customer may order. If the Customer does not wish to order a substitute product, VINTEMOD will refund the amount paid for the unwanted substitute product.

  11. ORDER REJECTION
    VINTEMOD reserves the right to withdraw any product from the website and/or remove or edit any material or content on the website. While VINTEMOD will make every reasonable effort to process all orders received, there may be exceptional circumstances where VINTEMOD may refuse to fulfill or confirm an order after receiving an order or sending an Order Confirmation. VINTEMOD will not be liable to the Customer or any third party for withdrawing any product from the website, removing or editing any material or content on the website, or refusing to fulfill or confirm an order after sending an Order Confirmation.

  12. DELIVERY
    Subject to the availability of stock (see clause 7 above) and except in extraordinary circumstances, VINTEMOD will deliver the products listed in the Delivery Confirmation by the date specified in the Delivery Confirmation, or if no delivery date is specified, within 30 (thirty) days from the Order Confirmation date. If there is a delay in the supply of products due to circumstances beyond VINTEMOD's control, VINTEMOD will inform the Customer as soon as possible and take measures to minimize the effect of the delay. VINTEMOD is not responsible for delays caused by conditions beyond its control. However, if there is a significant risk of delay, the Customer may contact VINTEMOD to terminate the Agreement and receive a refund for any products that have been paid for but not received by the Customer. No deliveries are made on Saturdays, Sundays, and public holidays.

  13. RISK AND OWNERSHIP
    All risks related to the products remain with VINTEMOD until delivery to the Customer or the person at the delivery address specified by the Customer, provided the Customer accepts the delivery via the courier/shipping company designated by VINTEMOD. Ownership of the products passes to the Customer upon delivery to the Customer or the person at the delivery address specified by the Customer.

  14. PRICE AND PAYMENT
    The prices of the products are as stated on the website. Although VINTEMOD strives to ensure that all prices on the website are correct, errors may occur. In the event of a price error on the products ordered by the Customer, VINTEMOD will notify the Customer as soon as possible, offering the option to confirm the order at the correct price or cancel the order. If VINTEMOD cannot reach the Customer, the amount paid for the products will be refunded, and the order will be considered canceled. VINTEMOD is not obligated to complete the sale at an incorrect (lower than normal) price if the pricing error is obvious and unmistakable, and the product's price could reasonably have been recognized as incorrect. Prices on the website include VAT and other applicable taxes but do not include delivery charges, which will be added to the total amount payable as specified in the Shopping Guide. Prices may change at any time, but price changes will not affect orders for which an Order Confirmation has been sent to the Customer (except as noted above). Therefore, no price changes will be permitted for previous orders (except as noted above). When the Customer completes their purchase, all the products they wish to buy are added to their shopping cart, and the next step is to complete the order and proceed to payment. To do this, the Customer must follow the steps in the purchase process, completing or confirming the information requested at each step. The Customer may also modify the order details in the purchase process before the payment process. Once the order is completed and before the Customer confirms payment, the basic characteristics of the purchased product, the total price of the product including all taxes, the conditions, period, and procedure of the right of withdrawal where applicable, and the information about the carrier foreseen by the seller for return or exceptional withdrawal will be presented to the Customer as an order summary. In cases where the right of withdrawal cannot be exercised, information regarding the loss of the right of withdrawal in certain situations will be brought to the Customer's attention in the order summary. Detailed explanations regarding the purchase process can be found in the Shopping Guide. Also, if the Customer is a registered user, all order details can be accessed in the "My Account" section. Payments are made via credit cards and debit cards using the payment methods displayed on the website and in the applications. The Customer's credit card information is encrypted to prevent unauthorized access. When VINTEMOD receives the Customer's order, a pre-authorization will be requested on the Customer's card to ensure that there is sufficient limit to complete the transaction. Payment collection will be made by VINTEMOD when the order is confirmed. By clicking the "Confirm Payment" button, the Customer confirms and declares that the credit card used belongs to them. Credit cards are subject to validation and authorization by the card-issuing institution, but if the card-issuing institution does not authorize payment to VINTEMOD, VINTEMOD will not be responsible for any delays or non-delivery, and the Agreement will not be completed.

  15. INVOICE
    The invoice will be issued and sent to the Customer along with the delivered products at the latest. VINTEMOD reserves the right to apply other methods in accordance with the e-invoice/e-archive legislation.

  16. PURCHASE WITHOUT MEMBERSHIP
    There is also an option to purchase products on the site without becoming a member. In such a purchase, only the information necessary to process the order will be requested from the Customer. After completing the purchase, the Customer will be offered the option to register as a user or continue as a non-registered user.

  17. VALUE-ADDED TAX
    Under the provisions of the applicable legislation, all sales transactions made through the website are subject to Value-Added Tax (VAT), except for final exemptions approved by the Customer.

  18. RETURN AND EXCHANGE
    You may return or exchange the products you wish to return within 3 business days following the day you receive your order by sending them to our address. For returns: Once your return reaches us, the amount will be refunded to your original payment method within 7 days. For exchanges: Exchange shipments are only accepted with "Post NL". The shipping
